Effective Date: April 23, 2026. By accessing or using any Train5D service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Train5D, LLC ("Train5D," "we," "us," or "our"). By accessing our website, creating an account, purchasing a product or subscription, or using any of our services, you agree to these Terms in full. If you do not agree, please discontinue use of our services immediately.

2. Description of Services

Train5D provides an integrated wellness platform that includes online training programs, educational content, assessments, group workshops, personal coaching, and a shop selling wellness-related products. Our services are available through train5d.com, training.train5d.com, shop.train5d.com, and affiliated subdomains.

3. Not Medical Advice

All content, programs, assessments, and materials provided by Train5D are for educational and informational purposes only. Nothing on this platform constitutes medical advice, diagnosis, or treatment. Train5D is not a licensed medical provider. You should always consult a qualified healthcare professional before beginning any new exercise, nutrition, or wellness program, especially if you have a pre-existing health condition, injury, or are pregnant.

By using Train5D services, you acknowledge and accept that you participate in any physical activity at your own risk.

4. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

5. Subscriptions and Payments

Train5D offers both free and paid subscription plans. By enrolling in a paid plan, you agree to the following:

• Billing: Subscription fees are billed on a recurring basis (monthly or annually, depending on the plan selected) until you cancel.
• Authorization: You authorize Train5D to charge your payment method on file at the start of each billing cycle.
• Price Changes: We may change subscription pricing with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.
• Failed Payments: If payment fails, we may suspend access to your account until the balance is resolved.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access until then. We do not offer prorated refunds for unused time within a billing period.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Share, resell, or redistribute paid content or materials without written permission
• Attempt to gain unauthorized access to any part of the platform or its infrastructure
• Upload or transmit any harmful, offensive, or infringing content
• Impersonate Train5D staff or other users
• Use automated tools to scrape, crawl, or extract data from the platform

8. Intellectual Property

All content on the Train5D platform — including but not limited to text, graphics, logos, videos, assessments, program materials, and software — is owned by Train5D, LLC or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without prior written consent.

9. Third-Party Services

Our platform may contain links to or integrations with third-party services (such as payment processors, scheduling tools, or social platforms). Train5D is not responsible for the content, privacy practices, or terms of those third-party services. Your use of third-party services is at your own discretion and risk.

10. Disclaimer of Warranties

Train5D services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees regarding specific results from use of our programs or products.

11. Limitation of Liability

To the fullest extent permitted by law, Train5D, LLC, its officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages — including loss of data, revenue, or health outcomes — arising from your use of, or inability to use, our services. Our total liability for any claim shall not exceed the amount you paid to Train5D in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Train5D, LLC and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Train5D services shall be resolved in the state or federal courts located in Tulsa County, Oklahoma, and you consent to personal jurisdiction in those courts.

14. Termination

We reserve the right to suspend or terminate your access to Train5D at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the platform ceases immediately.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. For material changes, we will notify you via email or a notice on the platform. Continued use of Train5D services after changes take effect constitutes your acceptance of the updated Terms.
